The Crown Development Agreement is a contract relating to the construction of an integrated hotel resort at Barangaroo in the development zone known as Barangaroo South. The contract is between the Barangaroo Delivery Authority (representing the NSW Government), Lend Lease (Millers Point) Pty Ltd (“Lendlease”, the developer of Barangaroo South), and Crown Sydney Property Pty Ltd (“Crown”, the developer of Crown Sydney Hotel Resort). The obligations of Lendlease are guaranteed by Lend Lease Corporation Ltd and the obligations of Crown are guaranteed by Crown Resorts Ltd.
The Crown Development Agreement [link] was signed by the parties to it on 27 May 2015. In June 2016 the NSW Planning Assessment Commission granted approval for the Crown Sydney Hotel Resort, comprising a residential component, hotel component, restricted gaming facility, retail area and car park. The building will be subject to a 99-year lease.
The Agreement permits Lendlease to nominate Crown as its nominee for the grant of a 99-year lease of premises within that part of Barangaroo South identified in Modification 8 as being for a hotel. The Agreement modifies Lendlease's rights under the Project Development Agreement to carry out development works on this part of Barangaroo South.
The Authority released the Agreement in line with its obligations under the Government Information (Public Access) Act 2009 on 30 July 2015.
The public domain around the integrated hotel resort will be retained in public ownership for the benefit the people of New South Wales.
